Terms & Conditions

These Terms & Conditions govern your use of the MAS Tire website, customer accounts, orders, and related services. Please read them carefully before placing an order or creating an account.

Acceptance of These Terms

These Terms & Conditions (“Terms”) apply to your access to and use of the MAS Tire Inc. (“MAS Tire,” “we,” “us,” or “our”) website, customer accounts, ordering tools, and related services.

By using the website, creating an account, submitting an account-registration request, or submitting an order, you agree to these Terms and to the related Privacy Policy and Return Policy. If you do not agree, you should not use the website or submit an order.

Account Registration and Approval

Where MAS Tire offers customer accounts, you must provide accurate, complete, and current information during registration and keep that information up to date.

Submitting a registration request does not guarantee that an account will be approved. MAS Tire may verify submitted business or contact information and may approve, reject, suspend, or close an account where reasonably necessary for business, credit, security, fraud-prevention, or compliance reasons.

You are responsible for keeping your login credentials confidential and for all activity performed through your account, except where that activity results from unauthorized access that you could not reasonably have prevented. Notify MAS Tire promptly if you become aware of unauthorized use of your account.

An account may not be required for every type of purchase or inquiry. MAS Tire may offer different ordering or service options depending on the circumstances.

Product Information

Product descriptions, specifications, sizes, images, and availability information on the website are provided for general information and product selection assistance.

MAS Tire makes reasonable efforts to keep product information accurate. However, minor differences may exist between website images and actual products. Product images may be supplied by manufacturers or distributors and may not always reflect exact appearance, packaging, or branding details.

You are responsible for verifying tire size, load rating, speed rating, compatibility, and suitability for your vehicle or intended use before placing an order.

Prices

All prices are displayed in Canadian dollars (CAD) unless otherwise stated. Applicable taxes, delivery charges, and other fees may be added to the displayed product price.

Prices may differ between customers based on account arrangements, volume, promotions, or agreed pricing.

Prices, product availability, specifications and promotions may be changed or withdrawn at any time without prior notice. The price applicable to an order will be the price confirmed by MAS Tire at the time the order is accepted.

MAS Tire will not retroactively change the confirmed price of an already accepted order unless both parties agree.

Pricing and Website Errors

MAS Tire may correct obvious errors on the website or in related communications, including errors involving prices, product descriptions, specifications, inventory, promotions, or typographical mistakes.

Where an order is affected by such an error, MAS Tire may reject or cancel the affected order or line items before final acceptance. If payment has already been collected for a cancelled order or cancelled item, any amount paid for the cancelled item will be refunded.

Orders and Acceptance

Adding products to a cart or wish list does not reserve inventory. Submitting an order constitutes an offer or order request to purchase the listed products subject to these Terms.

Automated emails, on-screen messages, or order numbers confirm only that MAS Tire has received your order request. An order becomes accepted only when MAS Tire manually or electronically confirms acceptance.

MAS Tire may accept, reject, limit, or cancel an order or any part of an order before acceptance. MAS Tire may also contact you to verify information, quantities, pricing, payment details, or pickup or delivery arrangements.

Inventory and Availability

Displayed inventory levels are estimates and may change quickly. All products remain subject to availability.

Inventory is not permanently reserved until an order is accepted. MAS Tire may partially fulfil an order, offer alternative products, or cancel unavailable items. Where reasonably possible, customers will be informed of material availability issues affecting an order.

Order Changes and Cancellations

If you need to change or cancel an order, contact MAS Tire immediately. Change and cancellation requests are subject to approval and may not be available in all cases.

An order may no longer be changed or cancelled after processing, allocation, pickup preparation, or shipping has begun. Special-order or specially sourced products may be non-cancellable once ordered from a supplier.

Payment and Credit Terms

Payment terms are based on the customer’s approved account terms, invoice, or other written agreement with MAS Tire.

MAS Tire may require payment before processing or releasing an order. Credit privileges, where granted, may be changed, suspended, or withdrawn at MAS Tire’s reasonable discretion.

Overdue balances may result in order holds, delayed shipments, account suspension, or collection activity. Any interest or late charges apply only where stated in the applicable invoice, credit agreement, or another written agreement.

Taxes and Additional Charges

Customers are responsible for applicable sales taxes, delivery or freight charges, handling fees where disclosed, and any other charges shown in the order confirmation or invoice.

Pickup, Delivery and Risk

Pickup and delivery details, including timing and location, will be confirmed separately for each order.

Delivery dates are estimates unless MAS Tire expressly agrees otherwise in writing. MAS Tire is not responsible for reasonable delays caused by circumstances outside its reasonable control, including carrier delays, weather, accidents, supplier shortages, or similar events.

Customers must inspect products promptly upon pickup or delivery. Visible shortages, damage, or discrepancies should be reported to MAS Tire as soon as reasonably possible.

Ownership and risk of loss transfer according to the confirmed pickup, delivery, or invoice terms for the order.

Returns

Returns are governed by MAS Tire’s separate Return Policy. No return is automatically approved. A return authorization may be required before products are sent back.

Non-returnable products, restocking charges, eligibility windows, and other return conditions are defined in the Return Policy.

Nothing in these Terms limits rights that cannot legally be excluded under applicable law.

Manufacturer Warranties

Products may be covered by manufacturer warranties. Warranty claims are subject to the manufacturer’s requirements, inspection process, and approval.

MAS Tire may assist with eligible warranty claims but does not control the manufacturer’s final decision. MAS Tire does not provide any additional product warranty unless expressly confirmed in writing.

Installation and Product Use

Tires should be inspected and installed by qualified automotive professionals in accordance with manufacturer guidelines and industry practices.

Customers are responsible for confirming fitment, vehicle requirements, load rating, speed rating, and intended use before purchase and installation.

MAS Tire is not responsible for problems caused by incorrect installation, improper use, modification, neglect, or failure to follow manufacturer instructions.

Website Availability

MAS Tire may update, suspend, limit, or discontinue website features at any time. The website may occasionally be unavailable due to maintenance, technical problems, or circumstances outside MAS Tire’s control.

MAS Tire does not guarantee uninterrupted, complete, or error-free access to the website. MAS Tire may correct or update website content without prior notice.

Prohibited Use

You agree not to use the website or related services to:

  • Engage in fraudulent activity
  • Provide false account or order information
  • Access an account without authorization
  • Scrape the website or use automated tools to extract pricing, inventory, or other content
  • Attempt to bypass security, authentication, or access controls
  • Introduce malware, viruses, or other harmful code
  • Copy or commercially exploit website content without permission
  • Use the website in a way that disrupts its operation or interferes with other users

Intellectual Property

The website design, branding, text, software, databases, and original content are owned by MAS Tire or its licensors and are protected by applicable intellectual-property laws.

Manufacturer names, product names, logos, and images remain the property of their respective owners. MAS Tire does not claim ownership of third-party manufacturer trademarks or trade dress.

Limitation of Liability

To the maximum extent permitted by applicable law, MAS Tire is not liable for indirect, incidental, special, or consequential losses arising from the website, these Terms, or any product or order. This may include lost profits, lost revenue, lost business opportunities, or business interruption.

To the maximum extent permitted by applicable law, MAS Tire’s total liability relating to a product or order will generally not exceed the amount paid for the affected product or order.

These limits do not apply where liability cannot legally be excluded or limited. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any other obligation that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold harmless MAS Tire and its directors, officers, employees, and agents from reasonable losses, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your misuse of the website
  • Your violation of these Terms
  • Fraudulent activity by you
  • Unauthorized account activity caused by your failure to protect your login credentials
  • Improper installation, resale, or use of products by you or anyone acting on your behalf

This indemnification obligation is intended to be proportional to the circumstances giving rise to the claim and does not expand liability beyond what applicable law permits.

Account Suspension and Termination

MAS Tire may suspend or terminate website or account access where reasonably necessary due to non-payment, fraud or suspected fraud, false information, security concerns, abuse of the website, or violation of these Terms.

Outstanding payment obligations and any provisions that by their nature should survive will continue after account closure or termination of access.

Privacy

Personal information collected through the website, accounts, and related services is handled according to MAS Tire’s Privacy Policy.

Electronic Communications

By using the website or creating an account, you may receive electronic communications related to your account, including order confirmations, invoice or payment communications, security notices, and other service-related messages.

Marketing emails will be sent only according to applicable consent requirements and, where required, will include a working unsubscribe mechanism. Unsubscribing from marketing messages will not prevent necessary transactional or account-related communications.

Changes to These Terms

MAS Tire may update these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date.

Changes apply prospectively to future use of the website and to future orders. Material changes will not retroactively alter an already accepted order unless required by law or agreed by both parties.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force and effect.

No Waiver

MAS Tire’s failure to enforce any provision of these Terms on one occasion does not waive the right to enforce that provision, or any other provision, on a later occasion.

Entire Agreement

These Terms, the applicable order confirmation, invoice, Return Policy, Privacy Policy, and any written account or credit agreement between you and MAS Tire form the agreement for the relevant transaction.

Where a written order confirmation or signed agreement conflicts with these general website Terms, the more specific written agreement controls for that transaction.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws.

Subject to any mandatory rights that cannot be excluded, disputes arising under these Terms will be resolved by the courts with jurisdiction in Ontario.
